CONTRACTOR AGREEMENT IN MEDICAL LAW
In Turkish Legal system there aren't any special legal regulations about the legal responsibilities of aesthetic surgeons. Yargıtay; the supreme court in Turkey is defining the legal relationship between the aesthetic surgeon and his patients as a contractor agreement. The principles of general medical interventions are also accepted for aesthetic operations.
In this study contractor agreement is researched within the scopes of medical law.
The legal responsibilities and obligations of aesthetic surgeons, rights of patients, defect concept, medical malpractice, complications and legal regulations are researched. All the subjects are explained both regarding Turkish law and the decisions of Yargıtay.
Since the importance of informed consents in contractor agreements has a much more greater volume than employment contracts, this subject has taken a broad interpretation.
We have content ourselves with comparing the differences of contractor agreement from other agreements but chose not to attempt analyzing the other agreements broadly.
The results and legal solutions of medical malpractice is researched under the light of Supreme Court decisions.
